Who Is Accountable When the System Is Wrong?

Every organisation deploying AI into consequential decisions will eventually face the question, and it is better to answer it before the incident than after: when the system gets it wrong — a person wrongly denied, a harmful action taken, a decision that cannot be justified — who is accountable? “The AI decided” is not an answer a regulator, a court, a customer or the public will accept, and a firm that cannot name a human accountable for an AI’s decisions has not deployed AI responsibly; it has diffused responsibility until no one holds it. Getting accountability clear is not a legal formality — it is the difference between AI you can defend and AI that becomes an unowned liability.

Why accountability is the hard problem AI creates

Automation has always raised questions of responsibility, but AI sharpens them because the system’s behaviour is less predictable and less interpretable, and because it can act at a scale and speed no individual reviews. When a person makes a bad decision, accountability is clear. When a model makes thousands of decisions, some wrong, through a process no single person fully understands, the instinct is to treat the outcome as no one’s fault — a property of the system rather than a responsibility of a person. That instinct is exactly the failure. Accountability does not disappear because a machine was involved; it has to be deliberately assigned, or it evaporates precisely where it matters most.

What clear accountability requires

  • A named owner for each consequential AI system. Not the AI, not “the team” — a specific person accountable for the system’s decisions and their consequences. If you cannot name them, you have your answer, and it is the wrong one.
  • Understanding sufficient to be accountable. Accountability is only real if the accountable person can understand what the system does well enough to answer for it, which is why explainability and oversight are not optional extras but preconditions for accountability.
  • The ability to intervene. An accountable owner must be able to stop, override or correct the system; accountability without control is a scapegoat, not a safeguard.
  • A trail that supports the answer. When asked who was responsible and why the decision was made, the firm needs the record — the logging, the lineage, the oversight — that lets the accountable person actually answer.

The board’s responsibility

This is ultimately a governance question, and it lands on the board. Regulators are increasingly explicit that accountability for technology and AI risk sits with the management body, which means the board cannot delegate its way out of the question. The useful board discipline is to require, for any AI system making consequential decisions, a named accountable owner who understands the system, can intervene in it, and has the evidence trail to answer for it — before the system goes live, not after it fails.
